1.1 Op alle aanbiedingen, bestellingen en overeenkomsten van Aniku Creations zijn bij uitsluiting van eventuele andere algemene voorwaarden deze Algemene Verkoopvoorwaarden (hierna: Voorwaarden) van toepassing. 

1.2 Het accepteren van een aanbieding dan wel het doen van een bestelling houdt in dat u de toepasselijkheid van deze Voorwaarden aanvaardt. 

1.3 Van het in deze Voorwaarden bepaalde kan slechts schriftelijk worden afgeweken, in welk geval de overige bepalingen onverkort van kracht blijven. 

1.4 Alle rechten en aanspraken, zoals in deze Voorwaarden en in eventuele nadere overeenkomsten ten behoeve van Aniku Creations worden bedongen, worden evenzeer bedongen ten behoeve van Aniku Creations ingeschakelde tussenpersonen en andere derden. 

Artikel 2. Aanbiedingen/overeenkomsten 

2.1 Alle aanbiedingen van Aniku Creations zijn vrijblijvend en Aniku Creations behoudt zich uitdrukkelijk het recht voor om de prijzen te wijzigen, in het bijzonder wanneer dat op grond van (wettelijke) voorschriften noodzakelijk is. Zie ook artikel 3.6. 

2.2 Een overeenkomst komt slechts tot stand na acceptatie van uw bestelling door Aniku Creations. Aniku Creations is gerechtigd bestellingen te weigeren dan wel bepaalde voorwaarden aan de levering te verbinden, tenzij uitdrukkelijk anders bepaald. Indien een bestelling niet wordt geaccepteerd, deelt Aniku Creations dit mee binnen tien (10) werkdagen na ontvangst van de bestelling. 

Artikel 3. Prijzen en betalingen 

3.1 De vermelde prijzen voor de aangeboden producten en diensten zijn in euro’s, inclusief BTW en exclusief handlings- en verzendkosten, eventuele belastingen of andere heffingen, tenzij anders vermeld of schriftelijk overeengekomen. 

3.2 Betaling dient vooraf te geschieden zonder korting of compensatie indien het leveringen tenzij anders schriftelijk overeengekomen. 

3.3 Betaling kan geschieden op (een van) de wijze(n) zoals aangegeven tijdens het bestelproces. Aan uw bestelling kunnen nadere (betalings-/bestel)voorwaarden worden gesteld. Bij betaling per bank of giro geldt als datum van betaling de datum van creditering van de giro- respectievelijk bankrekening van Aniku Creations. 

3.4 Bij overschrijding van de betalingstermijn bent u vanaf de dag dat betaling had moeten plaatsvinden in verzuim en bent u vanaf die dag een vertragingsrente van 1% per maand of een deel van een maand verschuldigd over het openstaande bedrag. Indien betaling plaatsvindt na aanmaning door Aniku Creations bent u een bedrag van tweeëntwintig euro en negenenzestig eurocent (€ 22,69) aan administratiekosten verschuldigd en indien Aniku Creations haar vordering ter incasso uitbesteedt, bent u tevens de incassokosten verschuldigd, welke tenminste vijftien procent (15%) van het openstaande bedrag zijn, onverminderd de bevoegdheid van Aniku Creations om in plaats daarvan de daadwerkelijk gemaakte buitengerechtelijke incassokosten te vorderen. 

3.5 Indien u met enige betaling in gebreke bent, is Aniku Creations gerechtigd (de uitvoering van) de betreffende overeenkomst en daarmee samenhangende overeenkomsten op te schorten, dan wel te ontbinden. 

3.6 Indien de prijzen voor de aangeboden producten en diensten stijgen in de periode tussen de bestelling en de uitvoering daarvan, bent u gerechtigd de bestelling te annuleren dan wel de overeenkomst te ontbinden binnen tien (10) dagen na mededeling van de prijsverhoging door Aniku Creations. 

Artikel 4. Levering 

4.1 De door Aniku Creations opgegeven levertijden zijn slechts indicatief. Overschrijding van enige leveringstermijn geeft u geen recht op schadevergoeding en evenmin het recht uw bestelling te annuleren dan wel de overeenkomst te ontbinden, tenzij de overschrijding van de leveringstermijn zodanig is dat van u redelijkerwijs niet kan worden verlangd dat u de overeenkomst in stand laat. U bent in dat geval gerechtigd de bestelling te annuleren dan wel de overeenkomst te ontbinden voor zover dat noodzakelijk is. 

4.2 De levering van de producten geschiedt op de plaats en het tijdstip waarop de producten gereed zijn voor verzending aan u. 

4.3 Indien een product niet leverbaar is bij Aniku Creations ontvangt u van Aniku Creations een creditfactuur in uw pakketje en Aniku Creations boekt het door u betaalde bedrag voor het product binnen 5 werkdagen retour. Aniku Creations stuurt geen producten na. 

Artikel 5. Eigendomsvoorbehoud 

5.1 De eigendom van geleverde producten gaat pas over, indien u al hetgeen u op grond van enige overeenkomst aan Aniku Creations verschuldigd bent, heeft voldaan. Het risico ter zake van de producten gaat reeds op het moment van de aflevering op u over. 

Artikel 6. Intellectuele en industriële eigendomsrechten 

6.1 U dient alle intellectuele en industriële eigendomsrechten welke rusten op de door Aniku Creations geleverde producten geheel en onvoorwaardelijk te respecteren. 

Artikel 7. Retour en aansprakelijkheid  

7.1 U heeft de verplichting om bij aflevering te onderzoeken of de producten aan de overeenkomst beantwoorden. Indien dit niet het geval is, dient u Aniku Creations daarvan zo spoedig mogelijk en in ieder geval binnen twee (2) werkdagen na de aflevering, althans nadat constatering redelijkerwijze mogelijk was, schriftelijk en gemotiveerd kennis te geven. 

7.2 Indien is aangetoond dat de producten niet aan de overeenkomst beantwoorden, heeft Aniku Creations de keuze de desbetreffende producten tegen retournering daarvan te vervangen door nieuwe producten dan wel de factuurwaarde daarvan te restitueren. 

7.3 Indien u een product om welke reden dan ook niet wenst af te nemen, heeft u het recht het product binnen zeven (7) werkdagen na aflevering aan Aniku Creations te retourneren. Retourzendingen worden in dit geval slechts geaccepteerd indien de verpakking van het product onbeschadigd is en de papieren verzegeling met sticker op de verpakking (zeepjes) niet is verbroken, waarbij tevens geldt dat de kosten voor verzendingen voor uw rekening komen. 

7.4 Lego kan niet worden geretourneert als de plasticverpakking is geopend en de seal is verbroken. Aniku Creations biedt nieuwe Lego steentjes aan en dit kan uitsluitend gewaarborgd worden als de verpakkingen ongeopend zijn.

Artikel 8. Bestellingen/communicatie 

8.1 Voor misverstaan, verminkingen, vertragingen of niet behoorlijk overkomen van bestellingen en mededelingen ten gevolge van het gebruik van Internet of enig ander communicatiemiddel in het verkeer tussen u en Aniku Creations, dan wel tussen Aniku Creations en derden, voor zover betrekking hebbend op de relatie tussen u en Aniku Creations, is Aniku Creations niet aansprakelijk, tenzij en voor zover sprake mocht zijn van opzet of grove schuld van Aniku Creations. 

Artikel 9. Overmacht 

9.1 Onverminderd de overige aan haar toekomende rechten, heeft Aniku Creations in geval van overmacht het recht om, naar eigen keuze, de uitvoering van uw bestelling op te schorten, dan wel de overeenkomst zonder rechterlijke tussenkomst te ontbinden, zulks door u dit schriftelijk mee te delen en zulks zonder dat Aniku Creations gehouden is tot enige schadevergoeding, tenzij dit in de gegeven omstandigheden naar maatstaven van redelijkheid en billijkheid onaanvaardbaar zou zijn. 

9.2 Onder overmacht wordt verstaan iedere tekortkoming welke niet aan Aniku Creations kan worden toegerekend, omdat zij niet te wijten is aan haar schuld en noch krachtens de wet, rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt. 

Artikel 10. Diversen 

10.1 Indien u aan Aniku Creations schriftelijk opgave doet van een adres, is Aniku Creations gerechtigd aan dat adres alle bestellingen te verzenden, tenzij u de aan Aniku Creations schriftelijk opgave doet van een ander adres waaraan uw bestellingen dienen te worden gezonden. 

10.2 Wanneer door Aniku Creations gedurende korte of langere tijd al dan niet stilzwijgend afwijkingen van deze Voorwaarden zijn toegestaan, laat dat onverlet haar recht alsnog directe en strikte naleving van deze Voorwaarden te eisen. U kunt nimmer enig recht doen laten gelden op grond van het feit dat Aniku Creations deze Voorwaarden soepel toepast. 

10.3 Indien één of meer van de bepalingen van deze Voorwaarden of enige andere overeenkomst met Aniku Creations in strijd mochten zijn met enig toepasselijk rechtsvoorschrift, zal de betreffende bepaling komen te vervallen en zal deze worden vervangen door een door Aniku Creations vast te stellen nieuwe rechtens toelaatbare vergelijkbare bepaling. 

10.4 Aniku Creations is bevoegd om bij de uitvoering van uw bestelling(en) gebruik te maken van derden. 

Artikel 11. Toepasselijk recht en bevoegde rechter 

11.1 Op alle rechten, verplichtingen, aanbiedingen, bestellingen en overeenkomsten waarop deze Voorwaarden van toepassing zijn, alsmede op deze Voorwaarden, is uitsluitend Nederlands recht van toepassing. 

11.2 Alle geschillen tussen partijen zullen bij uitsluiting worden voorgelegd aan de daartoe bevoegde rechter in Nederland.

1.1 These General Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders and agreements from Aniku Creations, to the exclusion of any other general terms and conditions.

1.2 Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions.

1.3 The provisions of these Terms and Conditions can only be deviated from in writing, in which case the other provisions will remain in full force.

1.4 All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of Aniku Creations, are also stipulated for the benefit of intermediaries and other third parties engaged by Aniku Creations.

Article 2. Offers/agreements

2.1 All offers from Aniku Creations are without obligation and Aniku Creations expressly reserves the right to change prices, especially when this is necessary based on (legal) regulations. See also article 3.6.

2.2 An agreement is only concluded after acceptance of your order by Aniku Creations. Aniku Creations is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Aniku Creations will notify this within ten (10) working days of receipt of the order.

Article 3. Prices and payments

3.1 The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.

3.2 Payment must be made in advance without discount or compensation if deliveries are made, unless otherwise agreed in writing.

3.3 Payment can be made in (one of) the method(s) indicated during the ordering process. Additional (payment/order) conditions may be imposed on your order. When paying by bank or giro, the date of payment is the date of crediting the giro or bank account of Aniku Creations.

3.4 If the payment term is exceeded, you will be in default from the day on which payment should have been made and from that day you will owe default interest of 1% per month or part of a month on the outstanding amount. If payment is made after a reminder from Aniku Creations, you owe an amount of twenty-two euros and sixty-nine euro cents (€ 22.69) in administration costs and if Aniku Creations outsources its claim for collection, you also owe the collection costs, which are at least fifteen percent (15 %) of the outstanding amount, without prejudice to Aniku Creations' authority to claim the extrajudicial collection costs actually incurred instead.

3.5 If you are in default of any payment, Aniku Creations is entitled to suspend or dissolve (the execution of) the relevant agreement and related agreements.

3.6 If the prices for the products and services offered increase in the period between the order and its execution, you are entitled to cancel the order or terminate the agreement within ten (10) days after notification of the price increase by Aniku Creations.

Article 4. Delivery

4.1 The delivery times stated by Aniku Creations are only indicative. Exceeding any delivery period does not entitle you to compensation, nor the right to cancel your order or terminate the agreement, unless the exceeding of the delivery period is such that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or terminate the agreement to the extent necessary.

4.2 Delivery of the products takes place at the place and time at which the products are ready for shipment to you.

4.3 If a product is not available from Aniku Creations, you will receive a credit invoice from Aniku Creations in your package and Aniku Creations will refund the amount you paid for the product within 5 working days. Aniku Creations does not send products afterward.

Article 5. Retention of title

5.1 Ownership of delivered products will only be transferred if you have paid all that you owe to Aniku Creations under any agreement. The risk regarding the products passes to you at the time of delivery.

Article 6. Intellectual and industrial property rights

6.1 You must fully and unconditionally respect all intellectual and industrial property rights that apply to the products supplied by Aniku Creations.

Article 7. Returns and liability

7.1 You have the obligation to examine upon delivery whether the products comply with the agreement. If this is not the case, you must inform Aniku Creations of this as soon as possible and in any case within two (2) working days after delivery, or at least after observation was reasonably possible, in writing and with reasons.

7.2 If it has been demonstrated that the products do not comply with the agreement, Aniku Creations has the choice to replace the products in question with new products upon return or to refund the invoice value.

7.3 If you do not wish to purchase a product for any reason, you have the right to return the product to Aniku Creations within seven (7) working days after delivery. In this case, returns will only be accepted if the packaging of the product is undamaged and the paper seal with sticker on the packaging has not been broken, and shipping costs will also be borne by you.

7.4 Lego cannot be returned if the plastic packaging has been opened and the seal has been broken. Aniku Creations offers new Lego bricks and this can only be guaranteed if the packaging is unopened.

Article 8. Orders/communication

8.1 For misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in the traffic between you and Aniku Creations, or between Aniku Creations and third parties, insofar as they relate to the relationship between you and Aniku Creations, Aniku Creations is not liable, unless and insofar as there is intent or gross negligence on the part of Aniku Creations.

Article 9. Force majeure

9.1 Without prejudice to its other rights, in the event of force majeure, Aniku Creations has the right, at its own discretion, to suspend the execution of your order or to terminate the agreement without judicial intervention, by notifying you in writing. sharing and this without Aniku Creations being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.

9.2 Force majeure means any shortcoming that cannot be attributed to Aniku Creations, because it is not its fault and is not its responsibility under the law, legal act or generally accepted views.

Article 10. Miscellaneous

10.1 If you provide Aniku Creations with an address in writing, Aniku Creations is entitled to send all orders to that address, unless you provide Aniku Creations with a written notification of another address to which your orders should be sent.

10.2 If Aniku Creations allows deviations from these Terms and Conditions, whether tacitly or otherwise, for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any rights based on the fact that Aniku Creations applies these Terms and Conditions flexibly.

10.3 If one or more of the provisions of these Terms and Conditions or any other agreement with Aniku Creations are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible provision to be determined by Aniku Creations. comparable provision.

10.4 Aniku Creations is authorized to use third parties for the execution of your order(s).

Article 11. Applicable law and competent court

11.1 All rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as these Terms and Conditions, are exclusively governed by Dutch law.

11.2 All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
